These terms govern your use of Floating Video (the “Service”), a video-greeting widget operated by Call Me Fred – adsyme Ltd, a company registered in England and Wales (company number 08301982), 86–90 Paul Street, London EC2A 4NE, United Kingdom (“we”, “us”, “our”). By creating an account or using the Service you agree to these terms.
1. The Service
Floating Video lets you record short video greetings and embed a floating video bubble on your own website with a single script tag, choosing which pages each greeting appears on. We do not supply, sell, or license any content — everything shown through the Service is provided by you. Features may change, improve, or be discontinued over time.
2. Your account
Sign-in is passwordless: we email a one-time magic link to verify your address. You are responsible for keeping access to your email account secure and for all activity under your account. You must provide accurate information and be at least 18 years old (or the age of majority where you live).
3. Acceptable use and content rights
You retain ownership of the videos, names, artwork, and other content you record or upload. You grant us a limited licence to host, process, transmit, and store that content solely to operate the Service.
You are solely responsible for ensuring you hold all necessary rights and consents for everything you publish through the Service — including the rights of any person who appears in a greeting. You must not use the Service for unlawful, infringing, hateful, or abusive content, or to harm the Service or other users.
4. Copyright complaints and takedown
We respect the intellectual property rights of others. If you believe content shown or hosted through the Service infringes your copyright, email [email protected] with the subject line “Copyright complaint”, including: (a) identification of the copyrighted work, (b) the URL where the allegedly infringing content appears, (c) your contact details, (d) a statement that you have a good-faith belief the use is not authorised by the rights holder, and (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act on their behalf.
On receipt of a valid complaint we will promptly remove or disable access to the identified content and notify the account holder, who may respond with a counter-notice. We terminate the accounts of repeat infringers.
5. Plans, pricing and billing
Floating Video offers a free tier that includes up to 100 greeting views, after which the widget stops serving until you upgrade. The paid Pro plan is $99 per year, plus any applicable sales tax or VAT, which is calculated and shown at checkout, and includes unlimited greeting views (subject to fair-use).
Payments are processed by Paddle, our authorised reseller and Merchant of Record. Paddle handles the transaction, invoicing, and applicable taxes, and their buyer terms also apply to your purchase. Subscriptions renew automatically each year unless cancelled.
6. Refund & cancellation policy
Cancel anytime. You can cancel at any time. Pro stays active through the end of the current billing period, after which it will not renew. To avoid being charged for the next year, cancel at least 48 hours before your renewal date.
14-day right to cancel (consumers). If you are a consumer in the UK/EU, you may cancel within 14 days of subscribing for a full refund, unless you have asked us to begin the service immediately and have started using it, in which case this right may no longer apply.
How refunds work. Refunds are handled case by case and processed through Paddle. We generally do not refund unused time on an active subscription, lack of use, or dissatisfaction with a feature, but we will always honour your statutory rights and will help resolve genuine technical problems. We may decline a refund where we find evidence of fraud or refund abuse. To request a refund or cancel, contact [email protected].
7. Fair-use view limits
The Pro plan includes a generous allowance of greeting views (one greeting played once counts as one view). If an account consistently exceeds a reasonable allowance we may contact you about a suitable arrangement.
8. Availability
We work hard to keep the Service reliable but provide it “as is” and “as available”, without warranties of uninterrupted or error-free operation.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses or lost profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these terms or applicable law. On termination your access ends and content may be deleted after a short grace period (see our Privacy Policy).
11. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email or in the app, and continued use after changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
